Supreme Court Asked to Clarify Who Pays Private School Tuition Under IDEA

In a brief filed at the end of July 2014, the National Association of State Directors of Special Education, the National School Boards Association and the Pennsylvania School Boards Association say that schools should be relieved of the responsibility to pay the bill for private school tuition once any court finds in a District’s favor, not through the appeal process to a higher court(s). Disability Scoop in an article dated July 25,2014 http://www.disabilityscoop.com/2014/07/30/supreme-court-clarify-idea/19560/ notes that the spokesman for the National School Boards Association was quoted as saying: “Once a district court determines that a school district has provided FAPE, its obligation to pay for the stay-put placement should end.” The Amicus brief filed by the National School Boards Association can be found here http://www.nsba.org/ridley-school-district-v-mr.  In a follow up article, dated October 7th, 2014, the Supreme Court asked for the Solicitor General of the Obama Administration to give input on the private school tuition issues before determining whether or not to consider the “stay-put” provision. http://www.disabilityscoop.com/2014/10/07/supreme-court-idea/19740/
