AB 1667 TB Testing Signed into Law

AB 1667 (Williams) was signed by the Governor on September 15, 2014 and will become law on January 1, 2015.  The bill would require the State Department of Public Health, in consultation with the California Tuberculosis Controllers Association, to develop a risk assessment questionnaire, to be administered by a health care provider, to conduct the tuberculosis risk assessments. This risk assessment questionnaire would be exempt from the rulemaking provisions of the Administrative Procedure Act (meaning that the questionnaire will not have to be submitted to a formal regulatory process by the State Dept of Public Health). At this time, CAPSES recommends all nonpublic schools and nonpublic agencies continue the regular TB testing process for current and prospective employees. In the future, as the questionnaire is completed, it is anticipated that administration of the risk assessment questionnaire (an every 4 year process as with TB testing) may be cost effective for public school districts, nonpublic schools and nonpublic agencies. CAPSES will inform its members of updates to this risk assessment process and provide a copy of the questionnaire as soon as possible. It should be noted that the risk assessment must be done by a licensed physician or nurse practitioner.
