California and the Majority of States are “deficient” in Special Education under IDEA: Over the last few years, the U.S. Department of Education has restructured the way in which they evaluate compliance with federal special education law (IDEA) and the changes have resulted in many states falling into the categories labeled “meets requirements,” “needs assistance,” “needs intervention” or “needs substantial intervention.” Federal data released last year for the 2011-12 school year indicated that 38 states met requirements, but using the new criteria focusing on student performance federal officials said just 15 states achieved the top rating in the latest round of determinations reflecting data from the 2012-2013 school year. Unfortunately California was which fell into the “needs substantial intervention” category (California, Delaware, District of Columbia, Texas).  The California State Performance Plan (SPP 2011, Posted by CDE January 2013) is a seven year plan for special education in California as required by IDEA 2004 along with the California Annual Performance Report (APR FFY 2012) are the California Department of Education most recent responses to the U.S. Department of Education since receiving the “needs substantial intervention” label from the Feds.  http://www.disabilityscoop.com/2014/06/24/most-deficient-special-ed/19466/
